Scratches on head draws attention to Tennessee maternity ward

Doctors, nurses and hospitals are there to keep us healthy and safe. Medical professionals rarely fail to do their jobs or do it poorly, but lawyers are there to protect patients' interests in these cases.

The family of a 3-month-old baby born in Nashville is seeking restitution after the infant was injured during the birth process. The mother posted photos online of the girl's head with some gouges and scratches that were reportedly caused by hospital instruments.

"It was a nightmare," said the mother. "That birth was traumatizing." The family reports that the injuries were caused by an amniotic hook used to break the amniotic sac, which usually induces labor in the early stages of birth. The mother recalls a midwife saying it was a tough sac and jamming the hook towards the baby.

The family thought the hook was scratching the sac but it apparently was scratching the baby's head. The infant also aspirated some of the amniotic fluid, later being admitted to the neonatal intensive care unit with hypothermia. "When I saw her head, my heart just dropped," said the mother.

Officials at the hospital did not immediate respond to calls after the birth, but the case was reopened after the photos were posted online. The head of the midwifery unit claims the incident does not constitute an error in care.

The victims of medical malpractice have the right to claim damages to cover medical expenses, end-of-life costs, wages lost during recovery and compensation for pain and emotional distress. An attorney may help victims and their families begin a lawsuit that leads to settlement, trial by jury or other successful conclusion.
