Tennessee company involved in medical malpractice case

A Tennessee-based health care management company is now the only remaining defendant in an ongoing case regarding a controversial and apparently false treatment for broken bones. The firm supplied support of various kinds to a hospital in New Mexico that hosted the treatments.

A pain management specialist testified that after reviewing the post-operative charts of more than 10 patients over a decade who had received the procedure, he contacted an administrator to stop the procedure from being conducted again due to pain and health hazards that it introduces.

The investigating doctor was also concerned that the osteopath who claimed to invent a bone-cementing procedure was not qualified to conduct spinal surgeries. This testimony could reintroduce the concept of corporate negligence to a case currently focused on medical malpractice.

The hosting hospital and the osteopath have already paid out $33 million in settlement totals. The remaining defendant is attempting to strike the new testimony as revealing confidential information, although a lawyer for the hospital said there was no evidence that this communication was protected by law.

The testimony comes from the first doctor consulted for an outside opinion on the experimental procedure. The doctor claims bone cement surgeries should have been halted in 2007, when the investigation first revealed problems.
